Transactional labor and employment attorney Merrili Escue has joined as Partner in the San Diego office and public and private sector labor and employment attorney Todd Simonson has joined as Partner in the San Francisco office.
Merrili advises employers in all facets of employment including hiring, discipline, performance management, termination, reductions in force, background checks, wage and hour compliance, leave of absence administration, and disability accommodation. She provides strategic and practical legal advice, taking into account the operational needs and realities of each client’s business. In addition to her counseling practice, Merrili has extensive experience in drafting all types of employment agreements, conducting due diligence for corporate transactions, employment practice audits, and client training on compliance and best practices for employee management. Merrili is also a certified workplace investigator and frequently represents employers before administrative agencies including the Department of Fair Employment and Housing, the California Labor Commissioner, and the Equal Employment Opportunity Commission. Todd represents clients in high-profile discrimination and harassment litigation, has prevailed in numerous arbitrations and administrative appeals upholding serious disciplinary action, and enforces management rights through effective collective bargaining. Todd regularly conducts complex workplace investigations on behalf of public and private sector clients, including investigations of high-ranking public officials. Todd also provides daily advice and counsel to clients about litigation avoidance, implementing disciplinary actions, collective bargaining issues, and the California Public Safety Officers’ and Firefighters’ Procedural Bill of Rights Acts. Todd is a sought-after trainer and presents seminars regarding a wide range of subjects, including: mitigation of liability risks; successful hiring practices; retirement issues; implementing and sustaining disciplinary actions; conducting defensible workplace investigations; and, preventing discrimination, harassment and retaliation (AB 1825) training. Before joining the team at SRC, Todd focused his practice at well-regarded local and national labor and employment firms, and was a criminal prosecutor – trying several cases to jury verdict. He earned his law degree while working full-time as a police officer for the City of Oakland.
