SRC successfully defended Massage Envy Franchising, LLC against a putative class action alleging violations of the Illinois Consumer Fraud Act and the Missouri Merchandising Practices Act. The Complaint was brought on behalf of all consumers who purchased a one-hour massage session at an independently owned and operated Massage Envy® clinic franchise in Illinois or Missouri. On June 12, 2017, the United States District Court for the Southern District of Illinois granted Massage Envy Franchising’s motion to dismiss, dismissing all claims with prejudice.

Plaintiffs filed an appeal to the Seventh Circuit Court of Appeals and held oral argument on February 7, 2018, with Luanne Sacks arguing on behalf of Massage Envy Franchising. On April 10, 2018, the Seventh Circuit affirmed the district court’s dismissal with prejudice.
